§ 1 Terms of Service

These terms of service define the rules for using the website gorilla-hr.com, hereinafter referred to as the „Service,” operated by Soft Gorillas Sp. z o.o., headquartered in Rzeszów, at ul. Jana i Jędrzeja Śniadeckich 20D/7, 35-006 Rzeszów, registered in the National Court Register under number KRS: 0000890717, NIP: 8133856997, REGON: 388472110.
The administrator of the Service can be contacted via email at: hr@softgorillas.com.

  1. Using the Service constitutes acceptance of these Terms of Service.

§ 2 Definitions

  1. User – A natural person, legal entity, or organizational unit using the Service.
  2. Candidate – A User who submits their CV and creates an account in the Service to seek employment or establish cooperation.
  3. Administrator – The entity managing the Service and responsible for its functionality.
  4. Candidate Profile – An account in the Service containing the Candidate’s data, managed by the User with moderation by the Administrator.
  5. Services – Services provided through the Service, including recruitment mediation, contract outsourcing, and career advice.
  6. Client – An entity submitting inquiries to cooperate with Candidates or request outsourcing services.
  7. User Account – An individual profile in the Service, automatically created for the Candidate upon applying for a job via forms on the Gorilla HR website. The account enables data management, acceptance of consents and declarations, access to job offers, and communication with the Administrator and potential Clients.
  8. Recommended Company Profile – A dedicated section in the Gorilla HR Service presenting verified companies deemed reliable recruitment or outsourcing partners by the Administrator. The profile includes current job offers or projects available for Candidates.

§ 3 Terms of Use

Account Creation and Management:

  1. Candidates automatically create individual accounts in the Service when applying for a job via the forms available on the Gorilla HR website.
  2. An account can be deleted at any time by submitting a request via email to hr@softgorillas.com, including the subject line: „Account Deletion – [Name and Surname].” The Service Administrator is obligated to delete the account within 14 days of receiving the request.
  3. The Candidate must accept the Service’s Terms of Service, Privacy Policy, and consent to the processing of personal data in accordance with GDPR when creating an account.
  4. Deleting an account does not affect previously concluded agreements or obligations with Gorilla HR or Clients.
  5. The Administrator reserves the right to refuse account creation if false information is provided or the Terms of Service are violated.

Data Security and Updates:

  1. The Administrator implements appropriate technical and organizational measures to ensure the security of personal data, in accordance with GDPR.
  2. Candidates have the right to update their personal data by contacting the Administrator at hr@softgorillas.com. The Administrator will update the data within 7 days of receiving the request.

User Obligations:

  1. Users are required to provide accurate and truthful information.
  2. Users must not include false information in their CVs. If a CV optimization tool generates inaccuracies, the User must correct them.
  3. Users accept the Privacy Policy and commit to maintaining data confidentiality.

Consent to Cooperation:

  1. The Candidate agrees to have their account processed for companies through Gorilla HR, provided that at the initial stage, the Candidate is presented to potential Clients in an anonymized manner without disclosing personal data. Personal data may only be disclosed after the Client accepts the Candidate’s profile and the Candidate consents to participating in the further recruitment process.
  2. The Candidate agrees to use Gorilla Software services as an intermediary if a project is found.

Third-Party Data Processing:
The Administrator may entrust the processing of personal data to third parties (e.g., IT service providers) under a data processing agreement in compliance with Article 28 of GDPR. The Administrator cooperates exclusively with entities that ensure an adequate level of data protection.

Limitation or Withdrawal of Consents:
Users have the right to limit or withdraw their previously given consents by contacting the Administrator at hr@softgorillas.com. Withdrawing consent does not affect the lawfulness of processing based on consent prior to its withdrawal.


§ 5 Data Protection

Data Security:
The Administrator implements appropriate technical and organizational measures to protect Users’ personal data, in compliance with GDPR.

Right to Deletion and Data Portability:

  1. Candidates may request the deletion of their data at any time by contacting hr@softgorillas.com. Data will be deleted within 14 days of receiving the request, except for data the Administrator is legally required to retain (e.g., for accounting or tax purposes).
  2. Candidates have the right to request the transfer of their personal data to another data controller by contacting the Administrator.

Notification of Data Breach:

In the event of a personal data breach, the Administrator commits to promptly notifying the supervisory authority in accordance with Article 33 of GDPR and informing affected individuals if the breach poses a high risk to their rights and freedoms.

Retention Period for Personal Data:

Personal data will be retained for as long as necessary to fulfill the purposes for which it was collected or as required by law. For data processed based on consent, the data will be retained until the consent is withdrawn.

Right to File a Complaint:

Users have the right to file a complaint with the President of the Personal Data Protection Office (PUODO) if they believe that the processing of their personal data violates GDPR regulations.

Cookies Policy:

The Service uses cookies that are necessary for the proper functioning of the website (technical cookies), as well as cookies for traffic analysis and marketing purposes (analytical and marketing cookies). Users can manage cookies settings in their browser. Detailed information is available in the Privacy Policy.


§ 6 Liability

  1. In the event of a breach of the Terms of Service by a User, the Administrator has the right to:
    • Block access to the account.
    • Delete the User Account.
    • Pursue compensation claims in accordance with applicable law.
  2. The Administrator is not responsible for the actions of Clients, including how they process personal data or their decisions regarding the employment of Candidates.

§ 7 Complaints

Complaints can be submitted electronically to hr@softgorillas.com.
The Administrator will review complaints within 14 days of receipt.
For matters related to data protection, Users can contact the Administrator at hr@softgorillas.com.


§ 8 Amendments to the Terms of Service

The Administrator reserves the right to amend the Terms of Service.
Changes will take effect 14 days after being published in the Service.

Service Liquidation:

In the event of Service liquidation, the Administrator commits to notifying Users at least 30 days in advance and deleting all personal data not required to be retained by law.


§ 9 Final Provisions

  1. Matters not regulated by these Terms of Service are governed by Polish law.
  2. Any disputes arising from the use of the Service will be settled by the court having jurisdiction over the Administrator’s registered office.
